HORSE SHIPPING CONTRACT:

Please note*

This form is based on “HORSES”.  Please call or e-mail if you have any questions in reference to any other type of
animal.  But be advised, the reference to “horses” in the contract will be used for any animal transported*

2.  Date (on or about) of pickup up horse(s)
3.  HORSES/OTHER ANIMALS TRANSPORTED:
4.   I will use due diligence to safely transport, feed, water, and care for the aforementioned horse(s), but can     
make no guarantees on to the health or physical condition of the horse(s) upon departure.  I have the right to take
pictures before putting the horse(s) on the trailer or taking them off, for proof or condition.

5.   The “shipped from” location if responsible for having, the ORIGINAL CURRENT NEGATIVE COGGINS, AND
THE ORIGINAL CURRENT HEALTH CERTIFICATES, IN ACCORDANCE WITH STATE LAWS FOR THE HORSE
(S) BEING TRANSPORTED TO AND THROUGH, COMPLETED AND READY AT TIME OF PICKING UP THE
HORSE(S).  If, at time of pickup of horse(s) are not ready to be shipped, due to incomplete paperwork, or obvious
signs of illness or injury, (per my discretion), the responsible party will be charged 25% of the transport fee.  It
will be at my discretion if I choose to wait on paperwork at a fee of $50 per hour.

6.  ALL INCIDENTAL AND CONSEQUENTIAL DAMAGES ARE EXCLUDED to the full extent permitted by law.   
S&B Transport will make every attempt to ship the horse(s) safely.  All adequate safety measures will be taken
at all times.  Rest and water will be offered every 3 to 4 hours.  OWNER(S) HEREBY RELEASES, WAIVES AND
DISCHARGES S&B TRANSPORT, OR ANY REPRESENTATIVES, FROM ANY AND ALL LIABILITY OR
OBLIGATION FOR ANY AND ALL LOSS, DAMAGE, CLAIM OR LIABILITY WHATSOEVER ARISING FROM OR
IN ANY WAY CONNECTED WITH THE TRANSPORTATION OF SAID HORSE(S).

7.  In case of Equine/animal emergency:  ALL attempts will be made to notify both parties involved in the
transportation of the horse(s).  A veterinarian will be called, at the expense of the party listed below, as agreed
upon by oral or written consent.  Please fill in responsible party information below:
Any injuries, scars, or pertinent information in regards to horse(s) condition prior to shipping: (videos or pictures
will be utilized as necessary).

8.  Insurance and Indemnification:  It is strongly recommended that parties involved obtain “full Mortality”
livestock insurance in an amount not less than the value of the horse(s).  Both parties involved shall indemnify S&B
Transport against any claims arising out of this contract or related in any way to the horse(s), including the
expenses of defending any such claim.  Owner, shipper, or agent, elects not to carry horse/animal/mortality
insurance.  Assumes all risk therein (to include, but not limited to injury, death, illness, disease, physical damage,
or harm).  The parties involved understand and acknowledge that insurance is not provided to the owner by the
transporter.  If the owner or its agents elect not to secure insurance, then he or she assumes all expenses or
liabilities associated with the transportation of the aforementioned horse(s).

9.  Any damage done to trailer or equipment will be the responsibility of owner, agent, or shipper.

10.  We do not require a deposit, but do ask that if you change your mind or have to cancel for any reason, that you
notify us ASAP, so we can also make different plans to keep the trailer full.    The balance of the shipping fee may
be paid in advance, at pick-up or at delivery PRIOR to unloading any horses.  We accept cash, cashiers check,
money orders. SORRY, but due to the large amount of bad checks we will not accept personal check.

11.  The rate you are quoted is for door to door delivery, (or, if another arrangements have been made due to
inaccessible roads) and care of your horse or other items.  However, surcharges may apply for any of the
following, depending on room in trailer and other variables.
  • A change in pick-up or delivery location from that quoted will be subject to a surcharge dependant upon
    review.  And charges applied as per mileage, if more than in quote.
  • Tack charges range from $25 for a small tack trunk or saddle to $100 for very large and         heavy tack
    trunks, or if the tack requires much effort to load and unload.  If not pre-scheduled, the decision to take
    tack is up to the driver.  As most tack room space is used for hay and other storage.
  • Waiting time at a barn for the pick-up or delivery person will be charged at a rate of $50 per hour after
    the first 30 minutes of waiting.  No horse(s) will be picked up, or delivered without a responsible party
    there, or the necessary paperwork.
  • Difficult access roads to locations will have a surcharge if not disclosed in the original quote.  The surcharge
    will depend on the difficulty of the road and the additional time required reaching the location.
  • Any damage to the trailer or equipment caused by your horse(s) may incur a surcharge.
  • A “hard loader/unload fee” of $50 per hour may be applied after the first 30 minutes of attempted loading
    or unloading a horse that is hesitant, unruly, or unwilling to load or unload.

  • If shipping boots, head bumper, tail wraps, or other wrappings is requested, we request that you provide
    them.  Please have them on at time of pickup.

If a horse is EXTREMELY agitated during shipping or at a time of pickup (and responsible parties agree) we do
carry tranquilizers on board and will be given if deemed necessary, at a $10 charge.  HOWEVER!, we will not be
held liable for any allergic or unknown side effects from the medication.  We reserve the right to NOT transport
uncontrollable horse(s), with a cancellation fee of 25%.
Owner or responsible party if agreeable to medicating the horse if necessary, and release of liability of
administering said medications.
Cancellations:  You will be advised of departure date, the date given will begin at 7 am and will be the date and
time used for cancellations fees.

Prior to 72 hours, thank you, and hope to be able to set something else up.
Less than 72 hours of trip, but prior to 24 hours of trip 10% of shipping fee.
Within 24 hours of trip 25% of shipping fee.

If at the pickup time of said horse(s), the horse(s) are not healthy enough to withstand the trip, show obvious
signs of illness, severe injury or lameness, or the paperwork is not in order at time of pickup, a charge of 50%
of the shipping fee will be assessed, and this will be considered a cancellation without 24 hours notice.  (This is
at the drivers discretion)

S&B Transport reserves the right to cancel trip, due to hazardous weather, mechanical difficulties, or
extenuating circumstances.  A full refund will be given if this occurs and if driver makes the decision to cancel
the trip.

Owner or agent understands that this is the entire agreement between the owner and S&B Transport, ad it
supersedes and cannot be modified in any way, unless in writing.

MY SIGNATURE BELOW INDICATES THAT I HAVE READ THIS ENTIRE AGREEMENT, UNDERSTAND IT
COMPLETELY, AND AGREE TO BE BOUND BY ITS TERMS IN ITS ENTIRETY.  ALL QUOTES OR BID ARE
SUBJECT TO WV. SALES TAX
